1. Introduction

These Terms of Service (“Terms”) govern your access to and use of OliveBox.net and the OliveBox Mobile applications for Android and iOS (collectively, the “Service”), operated by Mobi Mouse d.o.o., Stojana Protica 39, 11000 Belgrade, Serbia (“we”, “us”, or “our”).

By registering an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

2. Service Description

OliveBox is a cloud-based scheduling and business management platform designed for salons, wellness centers, and other professional service providers. The Service enables users to manage appointments, clients, staff schedules, and related business operations.

3. Eligibility and Accounts

• The Service is available only to businesses and individuals acting in a professional capacity.
• By creating an account, you confirm you are authorized to act for your business and that the information you provide is accurate and complete.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

4. Free Trial, Subscriptions, and Payments

• New users receive a 2-month free trial with full access to features. SMS messages sent during the trial are billed separately according to the current rate list.
• After the trial ends, continued use requires an active paid subscription (monthly or annual). Prices are shown in the applicable currency and include VAT where required.
• Subscription fees are due in advance for the chosen period. Payment obligations start upon trial expiry.
• Refunds: Subscription fees and unused periods are generally non-refundable, except as required by applicable Serbian consumer protection law.

5. Acceptable Use

You agree to use the Service lawfully and refrain from activities that could harm the Service or other users, including:

• Unauthorized access, probing, or disruption of systems or networks;
• Reverse engineering, decompiling, or attempting to derive source code;
• Sending spam or unlawful communications;
• Uploading content that infringes intellectual property, privacy, or other rights.

6. Data Ownership and Privacy

• You retain ownership of data you input into the Service (including your business data and your clients’ data).
• We process personal data in accordance with our Privacy Policy.
• We will not access or use your data except to provide, secure, and support the Service, comply with law, or as otherwise permitted by our Privacy Policy.

7. Client Data Responsibilities

You are responsible for ensuring that the personal data of your clients (e.g., names, emails, phone numbers, appointment records) is collected and processed lawfully, and that all necessary notices and consents are obtained under applicable data protection laws.

8. Service Availability and Updates

• We strive for high availability but do not guarantee uninterrupted operation.
• We may modify, update, or temporarily suspend the Service for maintenance, improvements, or to address security issues.

9. Termination and Data Deletion

• You may terminate your account at any time by contacting support@olivebox.net.
• Upon termination, your data will be permanently deleted after 12 months, unless a longer retention is required by law. You are responsible for exporting your data before deletion.
• We may suspend or terminate accounts that violate these Terms or applicable laws.

10. Intellectual Property

• The Service, including all software, designs, trademarks, and content, is owned by Mobi Mouse d.o.o. or its licensors.
• We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

11. Warranties and Disclaimers

The Service is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, punitive damages, or loss of profits, revenue, or data.
• Our total aggregate liability arising out of or relating to the Service shall not exceed the fees you paid for the Service in the 12 months preceding the event giving rise to liability.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or other liability that cannot be limited under applicable law.

13. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice by email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Serbia. Any disputes shall be subject to the jurisdiction of the competent court in Belgrade, Serbia.
